Terms & Conditions

In consideration for participating in taking psychedelic truffles at the retreat, “the Retreat” or “Event” or “Single day Session”, organized by Psychedelic Insights “the Company”, I “the Participant” agree to accept and be bound by the following Terms and Conditions.

1. On reservation, the Participant will pay the price of the retreat in full. If the participant cancels the event, a refund [except for the non-refundable deposit] will be paid. If you cancel, with

  • more than 3 months’ notice prior to the retreat date, the Participant will receive a refund of 90% of the sum paid, except for the non-refundable deposit
  • less than 3 months’ notice prior to the retreat date, the Participant will receive a refund of 65% of the sum paid, except for the non-refundable deposit
  • less than < 1 months’ notice prior to the retreat date, the Participant will receive a refund of 15% of the sum paid

2. The Company reserves the right to make changes to any and all aspects of the Retreat or its staff, times, trip order, etc., at the sole discretion of the Company. When the Company deems it necessary to do so, due to any reason, or conditions that may be (more) (psychologically) hazardous, dangerous, or otherwise adverse or threatening, circumstances out of the Company’s control or for any other reason considered necessary by the Company, the Participant will not be eligible for any refunds of any amount based on any such changes to the Retreat.

3. The Company reserves the right to cancel the Retreat at any time prior to the start date. In such an event, the Participant will receive a 95% refund of the amount remitted to the Company. The Company will not be responsible for any other amount, including preparation costs, damages, airfare, travel documents, or any other damages and/ or losses.
3a. When the planned trip-guide(s) cannot be present (e.g. illness, disease or other medical or mental health or other conditions or reasons) on the event day (retreat) the Company will provide alternative trip-guides which the participant will allow and agree to. The planned time can be affected and postponed.

4. The Participant is solely responsible for any travel insurance and for ensuring that he or she is adequately insured during of the Retreat with respect to possible illness, injury, transport, death, repatriation, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any other potential losses, damages, costs, expenses, or liabilities in any shape, way or form, directly or indirectly.

5. The Company is not responsible for any losses that the Participant incurs and/or sustains before, during or after the Retreat.

6. The Participant acknowledges to voluntarily participate in the services provided by the company and any physical or mental or breathing or meditative activity organized by the Company, as part of the Retreat, including but not limited to ingesting or using psychedelics.

7. The Participant acknowledges to be fully aware of the risks and hazards connected with participating or engaging in the services and activities organized by the Company, which may include the risk of serious injury (e.g., heart attacks, muscle strains, pulls, tears, flashbacks, Hallucinogen Persisting Perception Disorder (HPPD), broken bones, shin splints, and other physical or mental illnesses) or death, and hereby confirms and elects to voluntarily participate in the activities organized by the Company, as part of the Retreat.

8. The Participant acknowledges to voluntarily participate in being guided during an event organized by the Company, including participating in a psychedelic session, as part of the Retreat/ event.

9. The Participant acknowledges to be fully aware of the risks and hazards connected with participating or engaging in other activities organized by the Company, including participating in a psychedelic session, which may include the risk of medical, physical, mental or any other injury, damage or infliction, direct or indirect, or death, and hereby confirms and elects to voluntarily participate in other activities organized by the Company, including participating in a psychedelic session, as part of the Retreat.

10. The Participant recognizes that risks are involved in taking psychedelic substances and that any medical, psychological, or mental health outcome is due to the voluntary choice to do so by the Participant.

11. The Participant is aware of the risks involved in taking psychedelic substances and that unknown or unanticipated situations and direct or indirect risks may result in psychological issues, mental or physical injury, damage, flashbacks, Hallucinogen Persisting Perception Disorder (HPPD), infliction, direct or indirect, or resulting in death.
11.a The participant takes full responsibility for their own medical and psychological safety volunteer in the Companies services and all and any consequences resulting in mental of physical damage, illness, disease or other condition or afflictions that are directly or indirectly related to the activity including taking psychedelic substances. The participant is aware, informed and accepts the risks involved.

12. Because the Company Retreats involves the ingestion/utilization of psychedelic substances, i.e., psilocybin truffles, each Participant is screened for their safety prior to attending a retreat based on their testimony. The Participant hereby agrees that all information (s)he provides in the application is correct, complete and current, and that (s)he has disclosed all physical and psychological conditions, past traumas as well as all supplements, natural medicines, and medications (prescription and over the counter) that (s)he is taking. After the screening process, the Participant will be contacted personally by one of our staff to ensure that (s)he is prepared for the experience. The Company is not a medical facility, and its owners, staff, employees, and agents are not licensed medical doctors, psychiatrists, or mental health or medical practitioners. The Participant understands that, as researchers or retreat facilitators, the Company does not practice medicine, diagnose, cure, or treat diseases or illnesses. Instead, it functions as guides, and facilitates the effects that psychedelic substances have on people.

13. Representatives of the Company are not licensed to give advice on prescription medications. If the Participant is currently taking medication and decides to discontinue using it, he consults with his doctor before discontinuing any medications. If the Participant’s doctor approves discontinuing his medications, the Participant should follow the process provided to him by his doctor.

14. The Participant assumes full responsibility for any and all risks, including medical, psychological and mental health risks, involved in taking psychedelic substances.

15. The Participant understands that if he chooses to attend a Retreat without tapering off medications, that there is a significant chance that the experience with psychedelic substances will be reduced. The Participant also understands that he should not make any changes to his use of prescribed psychiatric medications until he has consulted with a licensed medical professional. The Participant agrees to review all emails and attachments that are sent by the Company as they will contain important information regarding his scheduled retreat. The Participant also agrees that he is submitting this application on his own behalf, that all information included is in regards to his own personal information, and that he is not submitting this application on behalf of anybody else.

16. The Participant assumes full responsibility for any and all risks, including medical, psychological and mental health risks, associated with physical and other activities organized by the Company, including participating in a psychedelic session, directly or indirectly, wholly or partially, immediate or manifesting later. 

17. In order to participate in physical and other activities organized by the Company, including participating in a psychedelic session, the Participant, for himself, his heirs, executors, administrators, assigns, personal representatives, estate, and all members of his family, knowingly, voluntarily, intentionally and irrevocably waives any and all rights, claims or causes of action of any kind whatsoever, arising out of the participation in physical and other activities organized by the Company, including participating in a psychedelic session, and hereby releases and forever discharges the Company and the psychiatrists, medical doctors, operators, owners, collaborators, partners, employees, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical, psychological or mental injury, any damages, any economical loss, any emotional loss or death, that Participant may suffer as a direct or indirect result of the participation in physical and other activities organized by the Company, including participating in a psychedelic session.

18. In the event the Participant is injured while participating in physical and other activities organized by the Company, including participating in a psychedelic session, the Participant agrees to assume all financial obligations for any and all costs.

19. In the event that any damage occurs to the equipment or facilities provided by the Company during the Retreat as a result of any actions, neglect or recklessness by the Participant, the Participant agrees to be held liable for any and all costs associated with these actions, neglect or recklessness.

20. The Participant acknowledges that this agreement is legally binding upon the Participant, for himself, his heirs, executors, administrators, assigns, personal representatives, estate, and all members of his family.

21. The Participant acknowledges and agrees that these Terms and Conditions, including the releases and waivers of liability, are intended to be as broad and inclusive as permitted by applicable law.

22. If any portion(s) of these Terms and Conditions is held by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, such portion(s) shall be interpreted and/or reformed without further action of the parties hereto to render them valid and enforceable when applied to the facts at issue and the lawfulness, validity, and enforce-ability of such provision(s) as applied to any other facts, and the lawfulness, validity, or enforce-ability of the remaining provisions of these Terms and Conditions shall in no way be affected or impaired thereby.

23. The Retreat and all physical and other activities organized by the Company, including participating in a psychedelic session, fall under the jurisdiction of the Kingdom of the Netherlands.

24. By participating in a Retreat, the Participant is aware of the potential dangers associated with participating in the Retreat and any physical and other activities organized by the Company, as part of the Retreat, including participating in a psychedelic session, and acknowledge that this is a consent, release of liability and a waiver of his rights to collect any damages in the event of personal injury, damages, death, or any other liability.

25. By participating in the Retreat, it is the Participant’s intention to assume all risks, including any medical, psychological, and mental health risks, personal injury, damages, death, and any other liability upon himself, to the exclusion of the Company, and to exempt the Company from all liability, now and in the future.

HOW WE STORE & MANAGE YOUR DATA

By using the www.psychedelicinsights.com Website, you permit the collection and use of your personal information as outlined below and you signify your agreement to this Privacy. If you do not agree with these terms, you should not use the Website.

THE PURPOSE OF THIS PRIVACY POLICY

Our Website psychedelicinsights.com, which includes any webpage containing this domain name, including any page that is enabled for use by a mobile device (the “Website”) and the services provided on the Website (the “PI Services”) are operated by Psychedelic Insights BV and (collectively “PI”, “we“, “us” and “our”). The Website and the PI Services help people discover more information about the use of magic psilocybin truffles, guide them to apply for and/or express interest in truffles sessions, and provide professional and investor related information.

This policy and any other documents referred to in either of them set out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. If you are a Client (e.g. an individual or group interested in magic psilocybin truffle sessions) then the PI Terms also form part of your agreement with us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

PI is the “data controller” for the personal information provided to PI. This means that PI is responsible for how the Personal Data is dealt with by PI employees and associated third parties.

HOW WE COLLECT INFORMATION

Clients (e.g., an individual or group interested in magic psilocybin truffle sessions)

Clients interested in booking an introductory call and applying for a magic psilocybin session that has been advertised on our Website must enter their personal contact details.

We also collect your personal data from public sources, such as IP address.

We may collect and process the following:

  • if you contact us, we may keep a record of that correspondence
  • information that you submit in response to booking an introductory call, a medical screening, and/or a magic psilocybin truffle session
  • details of your likes and dislikes about your past, present and future life
  • details of your psychedelic aspirations, personal motivations, and personality
  • details of any intentions and outcomes from the session that you have discussed with a facilitator
  • details of anything that would be a blocker in the pre-session process
  • details of anything personal that could impact, delay, or expedite your magic psilocybin truffle session
  • details of your visits to the Website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access
  • proof of identity that we request from you before we disclose personal information to you that we hold (in order to establish that we are disclosing the personal data to you and not to someone pretending to be you)
  • personal details that you submit to us, such as your name, address, telephone number, email address, gender, and date of birth
  • billing information

Professionals (e.g., scientists, researchers, psychologists, psychiatrists, etc.)

Professionals interested in working with PI should be aware that PI must have the full company name (if available), main contact name, contact telephone number, contact email address and any other such information pertaining to the services provided by PI that have been requested from the Professional.

The kind of data we may collect, and process, are some or all the following and your employees:

  • if you contact us, we may keep a record of that correspondence
  • information that you submit in response to surveys and/or polls
  • details of your work experience, and education, professional clubs, and associations that you belong to
  • issues and/or outcomes you have had previously with alternative therapy 
  • details of any limitation to us in onboarding you
  • any details of your past performance that you might request us to forward to Clients on your behalf during the Pre-Session processes
  • any promotional packs, leaflets, or PDFs you may have to help us to provide more detail to Clients
  • details of your company’s finance related info, such as VAT number, billing information, etc.
  • proof of identity that we request from you before we disclose personal information to you that we hold (in order to establish that we are disclosing the personal data to you and not to someone pretending to be you)
  • personal details that you submit to us, such as your name, address, telephone number, email address, gender, and date of birth

USES OF PERSONAL DATA

We hold no Client or Professional data on the Website.

When you book an introductory call on our website, your personal details come into our general mailing address, and they are available to our CRM for review. Your contact details are held both within an Introductory Call inbox, as well as on the platform from whence it came.

We use information held about you in the following ways:

 Clients

  • To provide perspective and to understand your intentions for this inner journey you may undertake, with the possibility to book further medical screening prior to the Session to ensure safety for you and PI, and to potentially discuss your Session experience with our team of facilitators, and if suitable, our Professionals.

Professionals

  • To provide registered Professionals with the possibility to find new Clients through our PI services and work with them in a safe setting
  • To provide registered Professionals with the possibility to discuss the area of psychedelic therapy with a view to understanding its growth potential, nationally, and globally
  • To provide registered Clients of PI Services with the correct information about Psychedelics and the safe use thereof. Submission of information by you, the Professional, is treated as confidential by us. 
  • To ensure that content from the Website is presented in the most effective manner for you and for your computer
  • To provide you with information, products, and/or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes
  • To allow you to participate in interactive features of our service, when you choose to do so
  • To notify you about changes to our service

We may also use your email address to send you updates or news regarding the Website or a PI Service, but you may choose not to receive emails of this type by either emailing info@psychedelicinsights.com with “UNSUBSCRIBE” in the subject line or clicking on the Unsubscribe link in the email.

We do not request (nor encourage you) to submit sensitive data to the Website, (i.e. data relating to racial or ethnic origin, political or religious opinions, membership of a trade union, physical or mental health or condition or sexual life, the commission of any offence or related documentation). If, however, you choose to do so then you consent to our processing this data in the manner set out in this Privacy Policy.

ON WHICH LEGAL BASIS DO WE PROCESS PERSONAL DATA?

We are not allowed to process personal data if we do not have a valid legal ground. Therefore, we will only process personal data if:

  • The processing is necessary to perform our contractual obligations towards you or to take pre-contractual steps at your request
  • The processing is necessary to comply with our legal or regulatory obligations
  • The processing is necessary to protect the vital interests of the relevant individual or of another natural person
  • The processing is necessary for the legitimate interests of PI and does not unduly affect your interests or fundamental rights and freedoms. Please note that, when processing your personal data on this basis, we always seek to maintain a balance between our legitimate interest and your privacy (e.g. to benefit from cost-effective services; to offer our products and services; to prevent fraud or criminal activity, misuses of our products or services as well as the security of our IT systems, architecture and networks; or to meet our corporate and social responsibility objectives); or
  • Where we have obtained your prior consent.

DISCLOSURE TO THIRD PARTIES

Data processing will be performed through the support of IT or automated tools, and paper hard copy and, in any case, a suitable medium for ensuring the security and the confidentiality.

The following subjects may be the recipients of communications of data as external data processors or, where the legal requirements are met, as autonomous Controller: (i) public authorities if PI is under a legal obligation to do so or where there is substantial public interest, (ii) third party service providers such as lawyers and auditing companies, credit institutions for payment provisions or other financial activities; (iii) affiliates and parent companies or associated companies of PI. PI may also disclose the data in other situations, such as where you have asked us to or where there is a legitimate reason do so.

If the personal data is transferred outside of the European Economic, this transfer will take place in compliance with the appropriate guarantees provided for by the applicable regulations and in compliance with the provisions of article 44 and following of the GDPR.

SECURITY AND CONTROL OF YOUR DATA

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will endeavour to protect your Data, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to endeavour to prevent unauthorised access. You acknowledge that we are not responsible for any intercepted information sent via the Internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorised manner. 

We collect only such information that is useful and required for the performance of the services we provide to the Client and Candidates. Any Data will be held for a period of 3 years, and in any event no longer than necessary with regard to the purpose of the data processing or as required by law.

IP ADDRESSES AND COOKIES

We may collect information about your computer, including (where available) your IP address, operating system, and browser type, for system administration, statistical purposes. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

LINKS TO THIRD PARTY WEBSITES

The Website may, from time to time, contain links to and from the websites of our partner networks, advertisers, and affiliates as well as third party websites to which we have no affiliation. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.

ACCESS TO INFORMATION AND UPDATING, VERIFYING AND DELETING DATA

At any time, you can make a written request to have access to all the personal information that we hold about you.

You may inform us of any changes in your Data and in accordance with our obligations to you, we will update or delete your Data accordingly. You may ask for a rectification thereof in cases where such personal information is inaccurate and incomplete. As a Client, Professional or Investor of PI, you have the right to ask for rectification thereof in cases where such Data is inaccurate and incomplete. You also have the right to ask for your Data to be erased from the PI’s systems and the systems of any third parties acting on its behalf.

You may, in your discretion, (i) refuse to communicate your Data to PI, (ii) refuse the aforementioned processing of the Data (in cases where the Data has been processed on the legitimate interest of the PI), or (iii) withdraw her/his/its consent to such data processing. In this event the PI may not be able to provide the Client with the Service.

To exercise these rights or for any other data protection queries, the Client/Candidate can contact us as follows: info@psychedelicinsights.com. Further, you have the right to ask questions or complain about how PI process your Data, including the right to complain to the relevant data protection regulator (The Dutch Data Protection Authority, “DPA”: Autoriteit Persoonsgegevens, PO Box 93374, 2509 AJ DEN HAAG, Tel.: (+31) – (0)70 – 888 85 00).

Before providing us with the relevant information, the Client shall inform individuals whose Data it provides to PI about the aforementioned data processing and their respective rights and provide a copy of the information in this Privacy Policy to them.

UPDATES OF THIS PRIVACY POLICY

Any changes we may make to our Privacy Policy in the future will be posted on this page and, where appropriate, may be notified to you by us to your e-mail. You should visit this page periodically to review any changes to the Privacy Policy.
